Legal Right of Setoff

A contractual right to net obligations with a bankrupt counterparty. In the United States, recent changes in the bankruptcy law have largely established netting rights in swaps and related risk management agreements if netting is covered in the master agreement between the parties. Other jurisdictions are moving in this direction in a competitive response. See also Netting Agreement.
